LIMITED WARRANTY OF MEMORY PROTECTION DEVICES, INC.

Memory Protection Devices, Inc., (“MPD”) warrants its electronic components (“Components”) against defects in materials and workmanship under normal use and service and on the conditions described in this warranty.

Warranty Period: Except as otherwise specified, this limited warranty remains in effect for a period of six (6) months from the buyer’s original date of purchase.

Exclusion: Components subjected to misuse, accident, modification, fire, flood or other casualty, shipping or transit accidents, adjustment, neglect, alteration or improper installation, operation, maintenance, repair or testing, or other acts or omissions not attributable to MPD are not covered by this limited warranty.

Coverage: MPD’s obligations are limited to: (i) the repair of the Component; (ii) replacement of the Component; or (iii) credit of the purchase price of the Component to the buyer’s account. MPD shall determine whether repair, replacement or credit shall be made. MPD reserves the right to make the final determination, based on its own evaluation of the Component, as to whether the problem in question is the result of a defect in workmanship or materials or the result of misuse, abuse or any of the other exclusions detailed above, or other cause outside of the responsibility of MPD. In the case of replacement or repair, MPD warrants that the parts replaced or repaired will operate properly and will be free from defects in materials and workmanship for ninety (90) days after the date of shipment to the buyer, or the remainder of the original limited warranty period, whichever is longer.

Obtaining Warranty Service: The buyer shall notify their MPD Representative, either by writing or by email within thirty (30) days after discovery of an alleged warranty issue. MPD will request detailed warranty claim information which must be supplied by the buyer. The buyer may be asked to return the Components, postage paid, to a location designated by MPD.

THIS WARRANTY IS IN LIEU OF ALL OTHER REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR INFRINGEMENT, AND OF ANY OTHER OBLIGATION OR LIABILITY ON THE PART OF MPD, WHETHER BY STATUE, CONTRACT, STRICT LIABILITY, TORT OR OTHERWISE. UNDER NO CIRCUMSTANCES SHALL MPD BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOST PROFITS OR COMMERCIAL LOSS, TO THE FULL EXTENT THOSE DAMAGES CAN BE DISCLAIMED BY LAW, AND IN NO EVENT SHALL MPD’S LIABILITY EXCEED AN AMOUNT EQUAL TO THE SALES PRICE OF THE PRODUCTS.
